These regulations govern the general terms of sale between the company Arte Legno Spello srl, with registered offices in Foligno cap. 0634, Via Angelo Catoleni 16/a (PG) Italy – VAT No. and Tax Code: 03341040545, and the customer making a purchase from the website www.artelegnoshop.it as a private consumer, in accordance with the provisions laid out in article 48 et seq. of Italian Legislative Decree No. 206/2005 (the Consumer Code), as modified by Italian Legislative Decrees No. 21/2014 and No. 70/2003.By completing a purchase order, the Consumer declares that they have read and accepted all these general terms of sale in their entirety.
SUBJECT OF THE CONTRACT
Arte Legno Spello srl uses the website www.artelegnoshop.it to offer an online service for the sale and delivery of the products displayed on the same website.
As these items are artisanally produced, their sizes may vary; however, they will always be made from olive wood as displayed in the photo.
EXECUTION OF THE CONTRACT
The consumer acknowledges that placing an order entails the OBLIGATION to pay the Company indicated above. Before the contract is fulfilled and before the order is placed, with the resulting “payment obligation”, the Consumer is informed of:
-the total price of the goods including taxes, with the stipulation that delivery costs and all other ancillary costs are not included in the price;
– the payment methods;
– the approximate time frame within which the Company undertakes to deliver the goods;
– the conditions, terms and procedures to exert the right to withdraw;
– the existence of a legal guarantee of conformity for the products purchased;
– the management of the personal data supplied when purchasing from and/or registering on the website.
At any time, including prior to the execution of the contract, the Consumer may view the information related to the Company: its geographical address, telephone number, and email address. Orders placed by the Consumer shall be understood as offers sent to the Company for the purchase of the selected products. The execution of the contract consists of the Company’s acceptance of these offers, in the form of an email of acknowledgement/confirmation. The Company shall keep a copy of orders received and confirmations sent for a reasonable period of time, in accordance with the Applicable Legislation.
Although it seeks to ensure the constant availability of the products featured on the website, the Company does not guarantee that they will always be available, even in cases where it has sent an email confirming the order. In such situations, the order will be automatically altered to remove the unavailable product, and the Consumer will be informed immediately via email. The cost of the unavailable product will subsequently be refunded in accordance with the provisions of the Applicable Legislation, through the means provided for (i.e. by bank transfer or by crediting the credit card used for payment).
The sale prices of all products featured on the website www.artelegnoshop.it are expressed in Euros and include VAT. Delivery costs are not included in the price of the products featured on the above website, but are indicated and calculated at the end of the purchasing process, before payment is taken. The Consumer accepts that the Company Arte Legno Spello srl has the right to change its prices at any time. The goods will be billed based on the prices indicated on the website at the time when the order is created, which will also be specified in the confirmation email sent by the Company to the Consumer.
RIGHT TO WITHDRAW
You have the right to withdraw from the contract of sale within 7 working days. The withdrawal period ends 7 working days after the date on which you or a third party designated by you — apart from the courier — takes physical possession of the products. In order to exercise this right, you must explicitly inform us of your decision to withdraw from this contract. You may send this or any other explicit declaration you wish to make by electronic means, to firstname.lastname@example.org
If you choose to do this, we will promptly send you confirmation of our receipt of your intent to withdraw using a durable medium (email, for example). To meet the deadline for withdrawal, it is sufficient that you send the notification regarding your wish to exercise your right to withdraw before the expiration of the withdrawal period. This notification must specify the items which you intend to return, and whether you wish to exchange them or obtain a refund. The Right to Withdraw does not apply to users who purchase in any role other than that of consumer (i.e. retailers).
– Effects of withdrawal:
If you withdraw from this contract, all payments you have made to us — with the exception of any delivery costs — will be reimbursed without undue delay, and in any case within no more than 14 days from the date when we were informed of your decision to withdraw from this contract. This reimbursement will be made using the same method of payment used by you for the initial transaction, unless you have expressly asked for another method to be used for reimbursement; in any case, you shall not incur any costs as a result of the reimbursement. Reimbursement will take place once we have received the returned item(s) at our headquarters. Consumers who have already received the goods sold under the contract are asked to return them to us without undue delay, and in any case within 7 days of the date on which we were informed of their withdrawal from this contract. This deadline will be considered as having been met if you send the goods within the period of 7 days. Reimbursement will only be made if the returned products are perfectly intact, unopened and unused. If a product is damaged upon arrival at its destination, please send an email to email@example.com with photos attached to demonstrate the damage. We will then proceed to replace the damaged product, subject to availability, and to send a courier to pick up the item being returned. Customers are reminded that the product ordered is accepted with reservation, and that responsibility for any damages lies with the courier.
Exceptions as per art. 59 of the Italian Consumer Code (Legislative Decree No. 206 of 06 September 2005):
Pursuant to art. 59, we hereby specify that withdrawal is not possible for the following items (e.g.: goods which are made to the customer’s specifications or which are personalised; goods which are liable to deteriorate or expire rapidly, such as organic foodstuff with a short shelf-life or products sold at a reduced rate because they are short-dated; goods which are perishable if their original packaging is opened; and in cases where the seal of warranty — where applicable — has been removed).
The Consumer declares that he/she is legally an adult and has the necessary capacity to enter into a legally binding contract between the Parties, and that the information he/she supplies when placing the order is up to date, accurate, and sufficient for the order to be completed.
